Preamble

These Terms and Conditions of Sale (hereinafter the "Terms") apply, without restriction or reservation, to any order placed by a customer (hereinafter the "Customer") with Lucie Clain, a French micro-entrepreneur (hereinafter the "Seller" or "MamanMarie"), for the digital products offered for sale on the website mamanmarie.fr (hereinafter the "Site").

Any order placed on the Site implies the Customer's full and unreserved acceptance of these Terms, to the exclusion of any other document. The Customer declares having read and accepted them before finalizing their order.

Article 1 — Seller identification

Article 2 — Products offered

The Seller offers digital content for sale (hereinafter "the Products"), notably novena booklets and spiritual works in digital (PDF) format, intended for personal, non-professional use.

Each Product is described on the Site (content, format, available language) with the greatest possible accuracy. Illustrations and visuals accompanying the description have no contractual value.

Article 3 — Price

Product prices are indicated in euros (€), all taxes included. The applicable VAT rate varies depending on the Customer's location, in accordance with VAT territoriality rules for digital products:

These amounts do not include any payment processing fees charged by the third-party payment provider.

The Seller reserves the right to modify prices at any time; however, the price applicable to an order is the one in effect at the time the Customer confirms the order. Promotional offers or launch pricing are valid for the period specified on the Site and subject to any stated limits.

Article 4 — Ordering

The Customer selects the Product of their choice on the Site, then proceeds to payment via the online payment solution provided (Payhip).

The order is only finally confirmed once payment has been confirmed by the payment provider. The Seller reserves the right to cancel or refuse any order from a Customer with whom there is a dispute concerning payment for a prior order, or in the event of suspected fraud.

Article 5 — Payment terms

Payments are made online, by credit card or any other method offered on the Site, via a secure third-party payment provider. The Seller does not store or retain any of the Customer's banking data; this data is processed exclusively by the payment provider, in accordance with its own terms and applicable regulations (including the PCI-DSS standard).

The full price is payable at the time of ordering.

Article 6 — Delivery and access

The Products sold on the Site are digital content not supplied on a physical medium. They are made available to the Customer by immediate download and/or by sending a download link by e-mail, upon payment confirmation.

It is the Customer's responsibility to verify the accuracy of the e-mail address provided when ordering. The Seller cannot be held responsible for non-receipt resulting from an incorrect entry by the Customer or from spam filtering by their mail service.

In case of difficulty downloading or non-receipt within 24 hours of purchase, the Customer is invited to contact contact@mamanmarie.fr.

Article 7 — Right of withdrawal

The law normally allows 14 days to change your mind after a purchase (Article L221-18 of the French Consumer Code).

In short: once the file is downloaded, no refund for withdrawal is possible.

This checkbox is built directly into the Payhip checkout process — without it, the order cannot be completed.

Article 8 — Intellectual property

All Products, texts, layouts, illustrations, and graphic elements making up the Site and the Products are protected by copyright and remain the exclusive property of the Seller.

Purchasing a Product grants the Customer a strictly personal, non-exclusive right of use. The following are prohibited, unless the Seller has given prior written authorization:

Any violation observed may be subject to legal action in accordance with the provisions of the French Intellectual Property Code.

Article 9 — Nature of content and limitations

The Products offered relate to spiritual and personal accompaniment (prayer, meditation, writing) based on the teaching of the Catholic Church. They do not, under any circumstances, constitute medical, psychological, therapeutic, or legal advice, and cannot replace professional pastoral, medical, or psychological support.

The Customer acknowledges that the use of the Products is their sole responsibility and personal undertaking, and that no particular result (well-being, peace of mind, spiritual growth) is guaranteed by the Seller.

Article 10 — Liability

The Seller undertakes to use all reasonable means to ensure quality access to the Site and the Products, without any obligation of result.

The Seller cannot be held liable for direct or indirect damages resulting from: improper use of the Product by the Customer, an interruption or malfunction of the Site or third-party technical providers (host, payment provider) beyond its control, or an event of force majeure.

In any event, should the Seller's liability be established, it shall be strictly limited to the amount actually paid by the Customer for the Product concerned.

Article 11 — Personal data

Personal data collected when ordering (name, e-mail, payment data processed by the third-party provider) is necessary to process the order and deliver the Product. It is processed in accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act.

For details on processing, retention periods, and the exercise of your rights (access, rectification, erasure, objection), the Customer is invited to consult the Site's Privacy Policy.

Article 12 — Complaints and consumer mediation

For any question or complaint, the Customer may contact the Seller at contact@mamanmarie.fr. The Seller undertakes to respond within a reasonable time.

In accordance with Articles L611-1 et seq. of the French Consumer Code, in the event of a dispute not resolved directly with the Seller, the consumer Customer has the right to use a free consumer mediation service to seek an amicable resolution. Article 13 — Force majeure

The Seller cannot be held liable for non-performance or delay in performing any of its obligations in the event of force majeure within the meaning of Article 1218 of the French Civil Code, including in particular outages or interruptions of hosting, payment, or e-mail services beyond its control.

Article 14 — Changes to these Terms

The Seller reserves the right to modify these Terms at any time. The applicable Terms are those in effect on the date of the order. The version currently published on the Site shall prevail.

Article 15 — Governing law and jurisdiction

These Terms are governed by French law. In the event of a dispute, and failing amicable resolution or recourse to mediation, the competent French courts shall be those of the defendant's place of residence, or any other court designated by the rules of jurisdiction applicable in consumer law.
